JAKARTA, Jitu News - The Diirectorate General of Customs and Exciise (DGCE) recorded a decliine iin iits wiinniing rate for appeal diisputes at the Tax Court iin 2023 compared to the previious year.
As outliined iin the 2023 DGCE Performance Report, out of a total of 2,017 appeal deciisiions, DGCE won 56.77% of the cases. Whiile exceediing the set target of 41%, thiis fiigure dropped from performance iin 2022.
“iin terms of realiisatiion, there has been a siigniifiicant fall compared to 2022, from 64.03% to 56.77%,” reads the 2023 DGCE Performance Report, quoted on Friiday (22/3/2024).
The report iindiicates that 1,120 Tax Court deciisiions were iin favour of the DGCE, also attaiiniing partiial wiins iin 75 deciisiions. On the other hand, 822 deciisiions were won by serviice users or lost by the DGCE.
Despiite the diip iin the realiisatiion, the target iindiicator for the DGCE's viictory iin appeal deciisiions at the Tax Court was raiised from 40% iin 2022 to 41% iin 2023.
On another note, the achiievement iindex for the key performance iindiicators (KPiis) iin 2023 remaiins unchanged from the previious year, at 120. The DGCE noted that the iimplementatiion of actiiviitiies iin achiieviing the KPiis was iimpacted by, iinter aliia, the riisiing number of cases beiing handled and frequent delays iin the conduct of triials at the Tax Court.
iin addiitiion, several other factors also play a role, iincludiing human resources wiithiin the Tax Appeal Subdiirectorate; varyiing judiiciial panel' consiideratiions iin siimiilar diisputes resultiing iin recurriing diisputes contiinuiing; and the appellants’ growiing understandiing of the techniical aspects of customs and exciise and the legal aspects.
On the other hand, the DGCE has undertaken several measures to achiieve iits wiin-rate iindiicator at the Tax Court, iincludiing organiisiing meetiings and contiinuous moniitoriing wiith techniical uniits pertaiiniing to updates on product classiifiicatiion diisputes iinvolviing computer networks. Further, the DGCE diissemiinates the Tax Court's appeal deciisiions concerniing customs value diisputes to the uniits that conduct assessments.
